Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of New South Wales, Australia, and any dispute concerning these terms and conditions shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

Changes to Terms and Conditions

We reserve the right to update or change these terms and conditions at any time. Your continued use of the website after any such changes constitutes your acceptance of the new terms and conditions. Changes apply to bookings made after the updated Terms are published. Existing confirmed bookings remain subject to the Terms in effect at the time of booking.

Accepting Terms and Conditions

By making a public booking or paying a deposit or full payment for a Private booking, you must check the box that states you confirm that you have read, understood, and agree to these Terms & Conditions.

Entire Agreement

These Terms supersede all prior agreements, understandings or representations (whether written or oral) relating to the subject matter. No other terms apply unless expressly agreed in writing.

Liability – Consumer Rights

Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy which by law cannot be excluded, restricted or modified (including under the Australian Consumer Law). To the extent permitted by law, our liability is limited to the cost of supplying the service again or refunding the amount paid.

Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be severed, and the remaining provisions remain in full force.

Force Majeure

We are not liable for delays or cancellations caused by events beyond our reasonable control (e.g. natural disasters, government restrictions).

Definitions

In these Terms and Conditions, unless the context requires otherwise:

  • “Paint Splice”, “we”, “us”, or “our” refers to A & A Creative Entertainment Pty Ltd, trading as Paint Splice.
  • “Client”, “you”, or “your” refers to any individual or entity making a booking or attending a Paint Splice session or event.
  • “Session” means any Public Session, Private Event, Kids Party, or other painting experience hosted by Paint Splice.
  • “Public Session” refers to a scheduled group painting event that is open to the general public and available for booking through our website or booking system.
  • “Private Event” means any session or event booked exclusively for a specific group, business, or individual, where the Paint Splice studio (or another venue) is reserved for that group only.
  • “Booking” means any confirmed reservation for a Session made via our website, email, phone, or in person, and includes both Public Sessions and Private Events.
  • “Deposit” means the non-refundable amount payable to secure a Private Event or booking, as specified in these Terms and Conditions or any related Quote or Invoice.
  • “Full Payment” means the total amount due for a booking, including the deposit and any additional charges such as extra attendees, materials, or services.
  • “Cancellation” means a request made by the Client to cancel or reschedule a confirmed booking in accordance with these Terms.
  • “No-Show” means a failure by the Client or any attendee to attend a confirmed session without providing notice of cancellation as required by these Terms.
  • “Quote” means a formal written or electronic offer issued by Paint Splice outlining the proposed event details, pricing, and conditions.
  • “Bond” means any refundable amount held temporarily to cover potential damages, as specified in these Terms.
  • “Custom Artwork” means any original artwork created by Paint Splice artists specifically for a Private Event, which remains the property of Paint Splice unless otherwise agreed in writing.
  • “Force Majeure Event” means any event beyond our reasonable control, including but not limited to natural disasters, government restrictions, illness, or other emergencies that may impact our ability to deliver services.
  • “Terms” means these Terms and Conditions, including any updates or amendments published on our website.
  • “Gift Voucher” means a prepaid card or code redeemable for sessions or merchandise at Paint Splice, subject to the terms on the voucher.
  • “Third-Party Platform” means any external website or service through which Paint Splice sessions or events are booked (e.g., ClassBento, Eventbrite, etc.).

Booking Terms and Conditions

Please read these Terms and Conditions (“Terms”) carefully before booking any service provided by A & A Creative Entertainment, trading as Paint Splice (“Company”, “we”, “us”, “our”).

Public Sessions

Cancellations of Public Sessions and Availability

We reserve the right to reschedule or cancel a session due to insufficient booking numbers or unforeseen circumstances. We will contact you as soon as possible should this occur. If a public session has not received sufficient bookings and a Private event request is received, the public session may also be cancelled.

If you are interested in and want to attend a specific public session, we strongly recommend booking in as soon as possible to avoid disappointment. Seats for our sessions can fill up quickly and we may only have limited number of seating still remaining. Due to limited supplies available and as we prepare for bookings based on booking numbers, we may not be able to accommodate additional attendees.

If you are booking for a larger group or if your group members are booking separately, we highly recommend contacting us prior to booking via email at [email protected] or by calling 0449 992 418 for seating availability to ensure we can accommodate for everyone.

Cancellations and Refunds

If you need to cancel your booking, please provide as much notice as possible by emailing [email protected] or calling 0449 992 418.

For security and record-keeping purposes, we do not accept cancellations made through social media, messaging services, or any other electronic platform.

Please include your booking confirmation number, booking name, or confirmation email when requesting a cancellation.

If a cancellation is requested by anyone other than the original ticket holder, we reserve the right to verify the request with the original ticket holder before processing it.

A cancellation is considered received only once acknowledged by us in writing (email confirmation).

Bookings can be cancelled or rescheduled up to 48 hours before the scheduled session time without penalty. If cancelling or rescheduling within 48 hours of the scheduled session time, a $25 cancellation fee per ticket (to cover committed materials, staffing, and admin costs) will apply, with the remainder of the ticket price to be refunded via the same method of payment as the original booking.

Please note that only the person under who’s name the booking was originally made may cancel or reschedule the booking, and if requested via email, the same email must be used as the original booking.

When a reschedule is requested, the new session must be with 30 days of the original booking, and must have adequate seats available. If the new session is of a higher ticket price, the additional amount must be paid before we will confirm your new booking. If the new session is of a lower ticket price, the price difference will be refunded.

Please allow up to 7 days for refunds to be processed by us. Note that due to financial institutions having different timeframes for processing refunds we cannot guarantee that you will receive any refunded funds into your account within this timeframe, but will process refunds from our systems in this timeframe.

Late Arrivals and No-Shows

If you are expecting to be late to the session or if part of your group will be late, please let the team know by calling us on 0449 992 418. If some members of your group are expecting to be late, on your arrival to the event inform the event host of the total number of late attendees and their expected arrival time. We will endeavour to plan and make adjustments to the session schedule if possible – unfortunately, we are unable to offer extended time to the session end.

Please note and respect that we may not be able to continue waiting and delay the session start time, as we need to ensure the majority of attendees can finish their paintings before session end/departure.

If you are late to the event, we ask that you please respect the other attendees by quietly speaking with the event host, who will assist you with promptly settling in so our team can catch you up, with minimal disruption to the session flow. Please note, if attendees are more than 1 hour late to a session, we are unable to allow you to paint and your payment will be forfeited, as the time remaining does not allow for a completed and dry painting by session end.

If a customer does not show up for the session, the full amount is still charged. We are unable to refund, reschedule or provide credit for a missed session.

BYO for Public Events

Responsible Service of Alcohol rules apply to BYO events as they do public sessions. A reasonable amount of alcohol for the number of attendees, and the session time will be allowed only. If excess alcohol is attempted to be brought into the venue we may not allow it and either hold it for you until the end of the event, or not allow it to be brought inside. Note that shots and rapid intoxication (including bottles of spirits and liquors ie-vodka, whisky etc) drinks are not allowed at any time. Please contact us prior to attending if you have any questions about acceptable alcoholic drinks.

Our staff are legally required to remove any attendee that is intoxicated or showing signs that they are becoming intoxicated from the venue.

Minors

Minors (anyone under the age of 18, or without sufficient ID proving their age) are allowed to attend any of our events (if we are informed at the time of booking), however no alcohol is to be consumed by that/those person/s under any circumstance.

All attendees must bring legal and current proof of age identification (in conjunction with RSA laws), as we reserve the right for any member of staff to ask to check any attendees identification at any time before or during the event. Failure to do so will result in the attendees being unable to consume alcohol. Any person/s found in violation of these regulations will be asked to leave the premises.

Please note all minors must be accompanied by a parent or legal guardian, and are the responsibility of their guardian at all times. At the time of booking we must be informed of any minors (and their age) as minors are not allowed without prior permission. No attendees under the age of 6 are permitted to participate in painting.

Private Sessions/Events

Private events are subject to the above terms, and the additional terms below (which take precedence if there is any conflicting information).

Private Bookings

Private bookings may be scheduled any time subject to availability. Please contact us on 0449 992 418 or at [email protected] to check availability and book your session.

Minimum numbers of attendees apply, and may differ depending on the day and time of your booking. Additional attendees may be added after the booking is made, however this cannot exceed our maximum capacity of 50 attendees.

Deposits, Payments, & Cancellations

A 20% non-refundable deposit must be paid at time of booking your Private session, with the full remainder to be paid no later than 1 week (7 calendar days) prior to your session date, or the booking may be cancelled at our discretion and any deposit forfeited. We will provide at least 48 hours notice via email prior to the session start before cancellation due to non-payment.

A Deposit payment link will be sent via email to be paid through our online booking system.

If the number of attendees increases after this time, then the difference must be paid immediately. We reserve the right to either charge the full ticket price, or to deny entry to any additional attendees at the time of the event that have not been paid for, or that may cause us to exceed capacity. Any reduction in numbers after the full payment is made will not be refunded.

A non-refundable deposit of 20% is required to secure your booking.
This deposit reserves the studio exclusively for your group and covers administrative and opportunity costs associated with turning away other bookings for that date and time.

Refund/Cancellation Terms

  • If you cancel 30 days or more before your event, you may request to transfer the deposit to another available date within 12 months, or to request a refund.
  • If you cancel within 30 days but more than 7 days of the event date, the deposit will be forfeited in full, as it is unlikely that we can rebook the studio on short notice.
  • If you cancel within 7 days of the event date, the deposit will be forfeited in full, and a fee of $25 per attendee will be charged to cover administrative costs.
  • If Paint Splice needs to cancel due to unforeseen circumstances, a full refund or reschedule will be provided.

Discounts

Volume discounts may apply for Private events, based on the number of attendees. If the number drops when the balance payment is due, this discount may be removed.

Discount coupons are not accepted for Private bookings, including gift cards, vouchers or any other discounted tickets.

Any Special Discount Offers are only applicable on 3 hour Private events/sessions with 10 or more attendees.

Number of Attendees

We understand that the number of attendees may change for Private events. When booking your event, minimum numbers apply (which may change depending on the day and time of the event). For any bookings for less than our minimum numbers of attendees, we suggest you attend as a group at a public session instead, otherwise a minimum charge to the amount of 10 attendees will apply.

Any change in the number of attendees will be reflected in your invoice and must be advised before payment is made so they can be adjusted accordingly. Any reduction in numbers in the 1 week prior to the booking date will not be refunded.

BYO for Private Events

Kid’s Parties

We allow ages 6 and up to attend one of our Kid’s Painting Parties/ Events. It is assumed that all kids attending a kids party will be participating in painting, if this is not the case you must inform us when booking your event, so we can review and advise.

Supervising adults are welcome (and required). If any adults want to join in with the painting, they are welcome to and will need to pay the standard rate for the session. Adults that don’t want to participate and are there to supervise only, will not be charged (this may be limited depending on participants).

Food / Catering

Please feel free to BYO food for private events, and advise us at least 1 weeks prior to the session if any special requests in regards to cutlery/serveware etc. Extra table(s) for food may be provided by us as long as requested prior.

If having the event catered, please note that the caterer may not have staff serving food/drinks and can only supply food and then leave. Our staff do not serve food/drinks, so buffet/share-plate style food is suggested.

We are happy to suggest local business that may cater or supply food for your event, simply give us a call.

Late Arrivals & No Shows

The event organiser is responsible for payment for all attendees tickets. Any no-shows will not result in a refund, the ticket will be forfeited, and cannot be transferred to another session/booking.

Please ensure that all attendees arrive at least 15 minutes prior to the session start time. If some members of your group are expecting to be late, on your arrival to the event inform the event host of the total number of late attendees and their expected arrival time. We will endeavour to plan and make adjustments to the session schedule if possible – unfortunately, we are unable to offer extended time to the session end.

Custom Artwork

Any custom artwork created by our artists for use in Private sessions, remains the property of Paint Splice. Charges for creating custom artwork is solely for our artists time, and does not infer any ownership of the artwork to anyone other than Paint Splice. The artwork may be re-used by us in any future sessions at our discretion. The artwork may be purchased for an additional fee, at our discretion. Clients receive no rights to reproduce or distribute the artwork unless separately agreed in writing.

Property Damage & Liability

All attendees are expected to respect the Paint Splice studio, its equipment, furnishings, and artwork. The event organiser is responsible for the conduct of their guests and for any damage or loss caused by any attendee during the event.

Any damage to Paint Splice property will be charged to the responsible attendee and/or the organiser of the private event. Charges will be based on the reasonable cost of repair or replacement of the damaged items, including any associated administrative or labour costs.

If any artwork displayed within the studio is damaged, a fee of $330 per artwork will apply, representing the typical cost of restoration or replacement. This includes, but is not limited to, any paint marks, spills, or other physical damage to the artwork.

Paint Splice is not responsible for any loss, damage, or theft of personal property belonging to attendees, nor for any injury, illness, or accident occurring as a result of misuse of equipment, failure to follow staff instructions, or behaviour outside of our reasonable control.

Bond

In some cases based on the number or age of attendees, or other factors, we may charge a bond at time of booking an event to cover damages or excessive cleaning required to any area of our studio or property.

This does not limit in any way any damage charges to the bond amount.

Following each event, we will inspect the studio for any damage or excessive cleaning requirements, with a final assessment completed within seven (7) business days. Where excessive cleaning is required to restore the studio to a safe and acceptable standard, it will be charged at a reasonable hourly market rate.

If no damage or excessive cleaning is identified, the bond will be refunded in full within seven (7) business days.
